A $975,000 settlement in a Nassau County medical malpractice action alleging that the plaintiff suffered compartment syndrome in his arm with neurologic damage in his hand after the defendants failed to diagnose and treat a MRSA infection. As a result of the delay in diagnosing and treating the infection, the plaintiff had to undergo a fasciotomy to relieve the compartment syndrome in his forearm. He also had to undergo procedures to remove and replace his cardiac pacemaker and defibrillator because the infection had spread to the hardware. The defendants argued that his symptoms were consistent with gout, which he had also had previously. As part of the settlement, the defendant hospital also waived its bill for the plaintiff’s medical care, resulting in an additional benefit to the plaintiff of over $160,000 that is not included in the $975,000 settlement payment.
