A $600,000 settlement in a Westchester County medical malpractice action alleging the failure to provide proper post-operative care to the plaintiff after undergoing surgery to repair a fractured cervical spine. As a result of the failure to properly monitor the plaintiff after his surgery, he was caused to suffer from paralysis and death after the hardware in his cervical spine had failed. Plaintiff alleged that there were signs and symptoms of a worsening neurologic condition that should have been investigated and would have resulted in discovery of the hardware failure before permanent damage was caused. The defendants argued that the post-operative changes were transient and normal for a patient after cervical spine fusion surgery.
