A $1,000,000 settlement in a Queens County medical malpractice action alleging the failure to timely and properly diagnose a myocardial infarction (heart attack) that led to the plaintiff suffering extensive heart damage. Plaintiff went to the emergency room with back pain that radiated to her chest. The defendant’s emergency room physician discharged the plaintiff from the emergency room without ordering a cardiac workup after misdiagnosing the plaintiff with musculoskeletal pain. The emergency room physician argued that an electrocardiogram that was performed did not indicate that plaintiff had a myocardial infarction. However, a subsequent interpretation by a cardiologist differed. Plaintiff was not advised of the second interpretation and, as a result, the blockages in her cardiac arteries that caused the myocardial infarction were not treated until months later after she suffered continued heart damage. A pre-trial settlement was reached with the financially distressed hospital. The plaintiff’s primary care physician also contributed to the settlement. It was alleged that the primary care physician had not been properly monitoring the plaintiff for heart disease given her risk factors.
