A $750,000 pre-trial settlement of a wrongful death action alleging that the plaintiff’s decedent was prematurely discharged from a psychiatric hospital and negligently discharged with contraindicated medication.  As a result of her premature discharge from the hospital, plaintiff’s decedent committed suicide by overdosing on sleeping pills that she should not have been prescribed.  The defendant psychiatrist testified at his deposition that it was appropriate to discharge the decedent from the hospital because the neck pain that was purportedly causing her depression had been treated during the admission.  This position was belied by the fact that the decedent had been discharged from the hospital with pain medications, evidence that she was still experiencing pain.  The decedent’s estate further alleged that the decedent should not have been prescribed a sleeping pill that had been known to increase suicidal ideation given the fact she had expressed thoughts of suicide during the admission.
